Can I subdivide my lot in BC?

Whether a lot can be split starts with its zone: the zoning bylaw sets the smallest lot a subdivision may create, and the lot must hold at least two of them. A report names the lot's zone and, where we've summarised the bylaw, its smallest new lot. An approving officer then decides, and on farmland the Agricultural Land Commission.

The report opens at this answer, with the lot drawn on the map and every other check alongside. A PID (on the tax notice or title) always finds the lot; an address works when it's an exact match.

What the answer means

The zone's smallest lot
The zoning bylaw, or a separate subdivision bylaw, sets the smallest lot a subdivision may create in each zone, sometimes larger where a lot has no community water or sewer. A lot under twice that size can't be split into two lots under the zone as it stands: the owner would usually need a rezoning first.
Who approves
An approving officer decides every subdivision under the Land Title Act: in a municipality, one the council appoints; outside municipalities, the Ministry of Transportation's provincial approving officer, unless the regional district or the Islands Trust has been authorised to appoint its own (ss. 77, 77.1). The officer can refuse a plan that meets the zone, for example where the land floods or slides, the access isn't enough, or it's against the public interest (ss. 85, 86).
Farmland (ALR)
Land in the Agricultural Land Reserve can't be subdivided without the Agricultural Land Commission's permission, whatever the zone says (Agricultural Land Commission Act s. 21). An application goes through the local government to the Commission.
Access and frontage
Every new lot needs access by a road, and where a lot fronts a road its frontage must be at least a tenth of its perimeter unless the local government sets more or exempts it (Local Government Act s. 512). The approving officer can ask for land for a new road or a wider one (s. 513). On a lake or the sea, a subdivision must give public access to the water by 20 m roads, generally every 200 m, or 400 m on rural land where every new lot is over 0.5 ha (Land Title Act s. 75).
Water, septic and services
The local government can require water, sewer, drainage and roads to its standards (Local Government Act s. 506). Where new lots will have wells and septic, expect to show that each has a safe water supply and room for a septic field; the health authority usually comments on the plan.
Park land
A subdivision creating three or more additional lots, the smallest of them 2 ha or less, can be asked for up to 5% of the land as park or its value in cash (Local Government Act s. 510).
A lot for a relative
The approving officer may allow a lot below the zone's smallest size to give a separate home to the owner's parent, child or grandchild (or the owner), after 5 years of ownership: the new lot must be at least 1 ha (as little as 2,500 m² with the medical health officer's approval), and it stays residential for 5 years (Local Government Act s. 514). On ALR land the Commission must also agree.
What it means for a buyer
Ask the local government's planning department for the zone's smallest lot, its servicing standards and any development permit area, and ask the approving officer about access. A BC Land Surveyor draws the subdivision plan. Budget for the survey, road and servicing works, fees and development cost charges, and months for approval.
