Where the bylaw is unclear

Points we couldn't settle from the bylaw's text. Ask before you rely on them.

  • A2: The fence height: Section 7.5.2 sets 2.0 m (2.4 m next to an agricultural, industrial or commercial zone) for rural residential zones and nothing for agricultural ones, and A2 is both, so its limit is unclear; ask the City of Kelowna.
  • RU2: The carriage house height: the table gives 'n/a' for RU2 (s. 11.6), so whether the main building's 11 m and 3 storeys or the 4.8 m for accessory buildings applies is unclear; ask the City of Kelowna.
  • RU3: The carriage house size and height: the tables give 'n/a' for RU3 floor area and height (ss. 11.5, 11.6), so what limits a carriage house here is unclear; ask the City of Kelowna.
  • RU5: The height limit for houses: the main height row for RU5 is marked deleted (s. 11.6), so the zone sets no general height, and what limits it is unclear; ask the City of Kelowna.
  • MH1: The fence height: Section 7.5.2 sets heights for the other zone families but doesn't name the Mobile Home zone, so the limit here is unclear; ask the City of Kelowna.
  • C1: Whether a drive-through is allowed on the lots the City's map marks C1 'dt-rcs': Section 14.9 lists no drive-throughs in C1, and Section 14.8 lists only the 'rcs' and 'str' sub-zones for it, so this is unclear; ask the City of Kelowna.
  • UC2: The floor area ratio for 4-storey areas: Section 14.14 gives UC2 a 4-storey height but no 4-storey density, so this is unclear; ask the City of Kelowna.
  • CD17: Whether a cannabis store is allowed with the 'rcs' sub-zone: Section 15.3.2 creates it, but the CD17 use table lists no retail cannabis sales, so this is unclear; ask the City of Kelowna.

Site-specific exceptions listed in the bylaw by legal description can add or change uses for one property, and development permit areas, the ALR and building rules apply on top. Confirm with the City of Kelowna's planning department before you buy or build.
