Where the bylaw is unclear

Points we couldn't settle from the bylaw's text. Ask before you rely on them.

  • CC-1: The floor space ratio. The consolidation sets it at 3.00 (s. 5.3). Bylaw 0230 (December 2025) restates s. 5.3 as "0.25, except as permitted by" the new density bonus, while its own table gives CC-1 a base of 3.0, and Council amended a figure from 3.0 to 2.5 before adopting it. The figure that now applies is unclear; ask the Sun Peaks Mountain Resort Municipality.
  • TA-1: Living in a unit here year-round, or renting it to a long-term tenant. The zone lists apartments and townhouses, but requires 70% of the floor area to be tourist accommodation, which only the owner may live in (Division One). Whether a unit counts as an apartment or as tourist accommodation, and so who may live in it, is unclear; ask the Sun Peaks Mountain Resort Municipality.
  • TA-2: Living in a unit here year-round, or renting it to a long-term tenant. The zone lists apartments and townhouses, but requires 70% of the floor area to be tourist accommodation, which only the owner may live in (Division One). Whether a unit counts as an apartment or as tourist accommodation, and so who may live in it, is unclear; ask the Sun Peaks Mountain Resort Municipality.
  • TA-3: Living in a unit here year-round, or renting it to a long-term tenant. The zone lists apartments and townhouses, but requires 70% of the floor area to be tourist accommodation, which only the owner may live in (Division One). Whether a unit counts as an apartment or as tourist accommodation, and so who may live in it, is unclear; ask the Sun Peaks Mountain Resort Municipality.
  • RC-1: Renting a home by the night. The zone lists hotels, motels and hostels but not tourist accommodation in homes, and the Municipality may allow it by temporary use permit (s. 3.10). Whether a home here may be rented nightly is unclear; ask the Sun Peaks Mountain Resort Municipality.
  • R-1: A December 2025 staff report to Council says suites are now allowed in all single-family zones, but the consolidated bylaw shows no such change and R-1 suites were still added lot by lot in 2026; whether a suite is allowed on other R-1 lots, under the bylaw or provincial housing rules, is unclear; ask the Municipality.
  • R-1: The smallest lot for a house on community water without sewer. Section 26.3(b) says 925 m² for a house or mobile home and s. 26.3(c) says 1,400 m² for a house. Plan on 1,400 m², and is unclear; ask the Sun Peaks Mountain Resort Municipality.
  • R-1: A duplex on community water without sewer. Section 26.3 sets no lot size for it, so whether one is allowed is unclear; ask the Sun Peaks Mountain Resort Municipality.

Site-specific exceptions listed in the bylaw by legal description can add or change uses for one property, and development permit areas, the ALR and building rules apply on top. Confirm with the Sun Peaks Mountain Resort Municipality's planning department before you buy or build.
