What the zone allows

Homes allowed
By the lot's subzone (s. 938). CD-38C (compact single family lots): one small-scale multi-unit housing development a lot, up to 4 homes (3 on a lot of 280 m² or less) where the lot meets the conditions below (s. 938C.2). CD-38B: townhouses, at most 52 a hectare (ss. 938B.1, 938B.3). CD-38A (neighbourhood commercial): one home a lot, for the owner, manager or caretaker and their family (s. 938A.3)
Main uses
CD-38A: every C-2B use (the C-2 uses: shops and services, offices, restaurants, assembly uses, group child day care, hotels, a liquor store, a liquor primary use, a container return centre of up to 280 m²; and gas bars), no business or accessory use over 450 m² of floor area (ss. 938A.1, 602B.1, 602.1). CD-38B: townhouses, home occupations, accessory buildings (s. 938B.1). CD-38C: homes, home occupations, accessory buildings (s. 938C.1)

CD-38A 3,716 m² (s. 938A.8); CD-38B 1.0 ha (s. 938B.8); CD-38C 220 m², 11 m wide (13.5 m on a corner), 18 m deep (s. 938C.7)
Lot coverage
CD-38A 40%, or 60% where at least half the required parking is inside the building or underground (s. 938A.4); CD-38B 50% (s. 938B.4); CD-38C 55%, and all buildings together at most 150 m² of footprint, 36 m² of it kept for a garage; covered porches, verandahs and sun decks not counted (s. 938C.3)
Height limit
CD-38A and CD-38B: as the development permit sets (ss. 938A.6, 938B.6). CD-38C: houses 9 m or 2.5 storeys, whichever is less, within the development permit; accessory buildings 3.75 m or one storey, whichever is less; hoop or arch buildings 2.0 m (s. 938C.4)
Setbacks
CD-38A and CD-38B: sited by the development permit (ss. 938A.5, 938B.5). CD-38C houses: front 6.0 m, though the house (porches, verandahs and stairs included) may come to 2.5 m, and the garage too where 6.0 m of driveway is left to the back of the sidewalk or curb; rear 4.5 m; sides 1.2 m; flanking local street 1.2 m (with the same 6.0 m of driveway in front of a garage facing it), flanking arterial or collector street 3.0 m. CD-38C accessory buildings: front 7.5 m, rear and sides 0.6 m, flanking local street 1.2 m, flanking arterial or collector street 3.0 m. Nothing above 1 m in a corner lot's sight triangle (6.0 m on local streets, 7.5 m on arterial or collector streets) (s. 938C.5)

The zone is one neighbourhood in three subzones: a neighbourhood commercial site (CD-38A), townhouses (CD-38B) and compact single family lots (CD-38C). The Township's zoning map shows the whole zone as CD-38, so which subzone a lot is in we don't read: ask the Township. A development permit from Council comes before any building permit in every subzone (ss. 938A.10, 938B.10, 938C.9).

CD-38A: business is carried on inside a building, except display, parking, loading, eating areas and seasonal uses (s. 938A.2).

Small-scale multi-unit housing (s. 102): up to 4 homes on one lot, attached or detached (3 on a lot of 280 m² or less), only where the lot is inside the Official Community Plan's urban containment boundary, under 4,050 m², on municipal sewer and water, not protected as heritage, outside the Willowbrook Transit-Oriented Area and not reached from an arterial road. A secondary suite may sit in one of these homes; that suites count toward the 4 is our reading. The bylaw sets no higher count near frequent bus stops. Which of these conditions a lot meets we don't check: ask the Township.

CD-38C parking: at least 4 spaces a lot, 2 of them side by side in an enclosed garage at least 6 m wide (no carports, no tandem parking in the garage) and 2 on a driveway at least 6.0 m wide in front of it; other subzones by s. 107 (ss. 938A.7, 938B.7, 938C.6).

Landscaping: CD-38A and CD-38B as the development permit sets; CD-38C by s. 111 unless a development permit or exterior design control agreement changes it (ss. 938A.9, 938B.9, 938C.8).

Home occupations (s. 104.3): the owner lives in the home; not in a secondary suite; on a lot of 1,011.7 m² or less everything stays inside the home; at most 50 m² in all, up to 4 people with at most one employee who lives elsewhere; no vehicle repair, manufacturing or outdoor storage. A licensed family day care for up to 8 children counts as one.

Short-term rental isn't a listed use in this zone, and neither is a bed and breakfast (the bylaw allows one only as part of a farm use, which this zone doesn't list). Ask the Township before renting a home by the night.

Uses the zone doesn't list aren't allowed, even where a general clause might seem to cover them (s. 101.4).

Site-specific exceptions listed in the bylaw by legal description can add or change uses for one property, and development permit areas, the ALR and building rules apply on top. Confirm with the Township of Langley's community development division before you buy or build.
