TA-2: Tourist Accommodation Two

A zone in Sun Peaks Resort Area Zoning Bylaw No. 1400 (Sun Peaks Mountain Resort Municipality). Our summary of Division Twenty of the bylaw as consolidated to 2025-05-07.

Floor space ratio 0.55 (s. 20.3); at least 70% of a building's floor area is tourist accommodation (s. 20.9(b)).

Shops and restaurants aren't listed uses on their own; as we read it, they come with a hotel, which by definition includes a restaurant, retail and assembly space (Division One). Restaurant, lounge, pub, retail, personal services, entertainment and assembly together take at most 30% of the floor area on a lot (s. 20.9(c)).

Living in a unit here year-round, or renting it to a long-term tenant. The zone lists apartments and townhouses, but requires 70% of the floor area to be tourist accommodation, which only the owner may live in (Division One). Whether a unit counts as an apartment or as tourist accommodation, and so who may live in it, is unclear; ask the Sun Peaks Mountain Resort Municipality.

Neighbourhood pubs also need provincial liquor licensing (s. 20.9(a)).

A landscaping plan must be approved, and finished within a year of the main building being completed. (s. 20.9(e))

Frontage at least a tenth of the lot's perimeter (s. 20.5(b)).

Parking (Table 4A): hotels, lodges and inns 0.7 spaces per guest room and 1 per sleeping unit (less above 100 units), or for homes 1 space per 55 m² plus 0.5 per further 40 m², at most 2 per home; no parking or driveways in the setbacks except the access from the road (s. 4.3(c)).

Fences: 1 m in the front setback, 2 m elsewhere (s. 3.5(a)).

Auxiliary buildings: at most 56 m², a strata plan counting as one lot (s. 3.2(d)).

Shipping containers only during construction under a building permit, removed within 14 days of completion (s. 3.9(b)).

Cannabis stores only where the bylaw names the lot (s. 3.8).

No auxiliary building before the main building, unless built under the same permit (s. 3.2(a)); auxiliary buildings are at most 5 m tall (s. 3.2(e)), and one attached to the main building counts as part of it (s. 3.2(b)).

Eaves, chimneys and bay windows may reach 60 cm into a setback; open stairs, balconies, porches and canopies 1.5 m into front and side setbacks and 2 m into the rear setback, with their supports outside it (s. 3.3). Domes, chimneys, antennas and screened rooftop equipment may rise above the height limit, up to 1.2 times it, over at most 10% of the roof (s. 3.4).

Height of a main building is measured from the average finished grade to halfway between the eaves and the ridge of a sloping roof (the top of a flat roof), averaged over the roof's planes by area as s. 3.7 sets out; an auxiliary building is measured to its highest point (Division One).

Tourist accommodation, as the bylaw defines it (Division One), is rooms or homes used for short stays by visitors or for the owner's own use; no one but the owner may live there.

Site-specific exceptions listed in the bylaw by legal description can add or change uses for one property, and development permit areas, the ALR and building rules apply on top. Confirm with the Sun Peaks Mountain Resort Municipality's planning department before you buy or build.
