What the zone allows

Homes allowed
Depends on the lot's lettered parcel (Schedule 7169-2): one house a lot on Parcels E, H, L, N and P; houses, townhouses or stacked townhouses on A to D and X to Z; townhouses or stacked townhouses on F, G, J, K, O, R and S (on S with a secondary dwelling unit, a home of 25 to 40 m² in an accessory building); apartments, townhouses and stacked townhouses, with houses on T and W or mixed-use buildings on I, M, Q, U and V. A house lot holds one home (s. 3.1.D). Townhouses at most 44.5 homes a hectare (Parcel S 86; K, O and R 30), apartments 123.5, mixed-use 148; at most 950 homes in the whole zone (ss. 1.1, 1.2, 3.2.C, 3.3.C, 3.4.C; Table 1.1 as Bylaw 8580 replaced it; s. 3.2.G.8). Bylaw 7600's homes-a-lot rule (s. 6.1.2(g)) doesn't reach zones made under Bylaw 2750 (s. 4.1.1), so whether the Province's small-scale housing floor gives more here is unclear: ask the City
Main uses
By parcel, as above: houses (a cottage courtyard is 7 to 12 bare land strata lots, each with a house, around a shared open space), townhouses, stacked townhouses, apartment buildings (purpose-built rental among them) and mixed-use buildings; home occupations, household pets and, except on the house-only parcels, shared open space. In a mixed-use building homes and live-work units may be on any floor and shops only on the ground floor: an artist's studio, bakery, barber and beauty shop, coffee shop, daycare, drug store, restaurants and bars, florist, food store, fitness centre, liquor store, meat market, offices, retail and shoe repair, and a brew pub only on the properties Schedule 7169-3 marks (Table 1.1, s. 2.2, as Bylaws 7882 and 8580 amended them)

By use: a house 240 m², 9.0 m wide (12.0 m on a corner), 20 m deep on average, or in a cottage courtyard strata 150 m², 7 m wide, 13 m deep (s. 3.1.E, as Bylaw 8580 replaced it); townhouses 330 m², 11 m wide, 30 m deep, strata lots 50 m² (s. 3.2.E); apartments 1,100 m², 30 m wide, 30 m deep, strata lots 40 m² (s. 3.3.E); mixed-use 450 m², 15 m wide, 30 m deep, strata lots 35 m² (s. 3.4.E). A house: front 3.0 m, rear 4.5 m, sides 1.5 m, flanking street 3.0 m (in a cottage courtyard front 1.5 m, rear 3.0 m, the front being the line on the shared open space); townhouses: front 3.0 m, rear 4.5 m, sides 2.0 m (0.0 m on Parcel S), flanking street 3.0 m; either may come to 0.6 m at the rear on a private lane. Apartments 3.0 m from every line; mixed-use front and sides 0 m, rear and flanking street 3.0 m; underground parking 0 m. Which lettered parcel (A to Z) a lot is in is on Schedule 7169-2, a map in the bylaw; the City's zoning map gives only "CD423R", so we don't know it here: ask the City, or find the lot on the schedule.

Nothing here may be used until sewer, water, fire protection, drainage and the roads serving the land are built to the City's standards as of December 31, 2013 (s. 1.5).

Parking: a house one space (a cottage courtyard's may be on common property); townhouses 1.5 a home plus 0.1 for visitors (Parcel S 2 a home and 1 a secondary dwelling unit); apartments 1 plus 0.1 for visitors, purpose-built rental 0.75 plus 0.1; shops 1.5 a 100 m² (offices 2, barbers, beauty shops and fitness centres 3) (ss. 3.1.F, 3.2.F, 3.3.F, 3.4.F, as Bylaw 8580 amended them). No vehicle or trailer over 5,500 kg parked on a lot.

Shared open space: 3 m² a home for townhouses, 1.5 m² for apartments, 30 m² for a cottage courtyard house; an apartment home at least 35 m²; a purpose-built rental building is held by a covenant against strata titles for its life (ss. 3.1.G.5, 3.2.G.1, 3.3.G.1, 3.3.G.7, 3.3.G.8).

A house takes at most 2 boarders or lodgers; fences at most 1.2 m high in front and flanking setbacks, beside public use land or a public path; no storage outside a building (ss. 3.1.G, 3.2.G).

A brew pub's manufacturing and warehousing at most 250 m² (s. 3.4.G.6, added by Bylaw 7882).

Lots here are often strata or bare land strata lots: what an owner may do (renting, changes) is in the strata's bylaws as well, so read them.

Bylaw No. 7600 doesn't apply here: the zone was made under the old Zoning Bylaw No. 2750, kept in force for its Comprehensive Development zones (Bylaw 7600, ss. 4.1.1, 20.2.1), and the general rules it points to (ss. 603 to 610A for homes, Part VII for shops, Part IX for parking) are that bylaw's (s. 1.4).

Short-term rental isn't a use this zone lists; ask the City of Delta before renting a home short term.

Site-specific exceptions listed in the bylaw by legal description can add or change uses for one property, and development permit areas, the ALR and building rules apply on top. Confirm with the City of Delta's planning department before you buy or build.
