What the zone allows
- Homes allowed
- Up to 1,300 homes across the zone: houses, semi-detached homes, townhouses, stacked townhouses and apartments, with secondary suites of up to 90 m² (s. 15.4.5)
- Main uses
- A resort community in four areas (Map A of the bylaw; the City's map doesn't show which area a lot is in). Area I, Village Centre: homes, hotels, shops (one tenant up to 5,500 m²), restaurants and pubs (100 people), offices, personal and professional services, health, education, cultural and recreation, religious assembly, child care, emergency services, parks, boat storage, parking. Area II, Winery and Resort Accommodation: homes, hotels, alcohol production, restaurants and pubs, shops up to 235 m². Area III, Hillside Resort Accommodation: homes, hotels, health services. Area IV, Waterfront Resort Accommodations: homes, hotels, a marina, restaurants and pubs, shops up to 235 m², parks, boat storage

- Height limit
- Area I 9 storeys and 38.25 m; Areas II and IV 6 storeys and 29.5 m; Area III 3 storeys and 11.5 m (s. 15.4.5)
- Setbacks
- 0 m from lot lines; 10 m from the CD zone's boundary (1.5 m where it faces the Okanagan Lake riparian area or parks) (s. 15.4.5)
The whole zone is capped at 271,500 m² of floor area (tracked through a covenant on the remainder lands), 1,300 homes and 15,000 m² of commercial floor; offices and professional services at most 5,000 m² in all, 2,000 m² per building and 500 m² per tenant (ss. 15.4.3, 15.4.5).
Short-term rental without a resident operator (with the 'str' sub-zone) is listed for Areas I and IV; the table leaves Areas II and III blank (s. 15.4.3). Short-term rental by a resident is allowed in all four.
Above 6 storeys in Area I, or 4 in Areas II and IV, any storey with parking that's exposed is 60% living space on the outside (s. 15.4.5).
Shared and private outdoor space for apartments and townhouses: 7.5 m² per studio, 15 m² per one-bedroom, 25 m² per larger home (s. 15.4.5).
Secondary suites (s. 5.3): inside a house, a semi-detached or duplex home or a townhouse (never an apartment or a boarding house), built to the BC Building Code with an occupancy permit, on a lot with community water, and never titled apart from the home; at most 90 m² of floor area.
Short-term rental (stays under 90 days, s. 5.3) is allowed as a minor use only: run by a principal resident who lives in the home more than 240 days a year (a suite or carriage house by a resident of the same lot); one booking per home at a time; up to three bedrooms of two adults each; on a lot with a house and a suite or carriage house, at most two homes and five bedrooms let this way (s. 9.10).
Minor home-based businesses (s. 9.2): run by a resident who lives there more than 240 days a year, inside the home, residents only, one client at a time, up to 20 m² and 25% of the home; no outdoor storage or work, no nuisance and no commercial vehicle over 5,500 kg.
Sections 6 to 9 of the bylaw (general rules, landscaping and fences, parking, specific uses) also apply.
On a lot beside Highway 97 or Highway 33, buildings and structures stand 4.5 m from that lot line (s. 6.4).
Setbacks from streams and lakes are those of the official community plan's riparian management areas, measured from the top of bank (s. 6.5).
Site-specific exceptions listed in the bylaw by legal description can add or change uses for one property, and development permit areas, the ALR and building rules apply on top. Confirm with the City of Kelowna's planning department before you buy or build.
