A zone in Lasqueti Island Land Use Bylaw No. 78, 2005 (Lasqueti Island Local Trust Committee). Our summary of Section 4.2 of the bylaw as consolidated to 2025-03-14.

What the zone allows

Homes allowed
One home on any lot; more by lot area in the lot's subdivision district: one per 4 ha in District A, per 8 ha in District B, per 65 ha in District C (s. 3.9(1), (2)); a guest cabin with each home (s. 3.9(3)); on a lot in two zones, one home per 4 ha (s. 3.10). Which district a lot is in is on the bylaw's Schedule C map, not on our map, so it is unclear here
Main uses
Homes, agriculture, forestry, mariculture facilities, slipways and home enterprises (s. 4.2(1)); farm buildings, including temporary quarters for transient farm workers, accessory buildings and other buildings for those uses (s. 4.2(2)); in the Agricultural Land Reserve, the farm uses the Province's ALR regulation allows (s. 3.4)
Smallest lot for a subdivision
4 ha in Subdivision District A, 8 ha in District B, 65 ha in District C (s. 3.11(1)); in the ALR the Agricultural Land Commission must approve too (the note to s. 3.11)

Setbacks
None from lot lines for the zone's buildings (s. 4.2); 15 m from the sea, or 7.5 m where bedrock or engineered works protect the shore, boathouses 5 m, the lowest floor 1.5 m above the sea's natural boundary (s. 3.5(4)); 30 m from streams, lakes, wetlands and watercourses (s. 3.5(3))

The zone covers the island's land outside its few commercial, industrial, institutional and watershed zones (s. 4.1).

Guest cabin (ss. 3.8, 3.9(3)): up to 56 m², for guests of the household who don't pay, not a home and not rented long term; a travel trailer, bus, boat or RV of up to 56 m² may stand in for it.

Short-term rental: a guest cabin may be rented for under 30 days only on land with Commercial 3 (tourist accommodation) zoning (s. 3.8(6)), and tourist accommodation is a Commercial 3 use, not a Land Based one (ss. 4.2(1), 4.6); in this zone, paying guests stay only in a bed and breakfast.

Bed and breakfast (s. 3.6(b)): a home enterprise for overnight visitors, in the owner's or occupier's permanent home, up to three bedrooms, one per home (each home on a lot with more than one may run one).

Home enterprises (s. 3.6(a)): part of a lived-in home and run by at least one resident, nothing noisy, smoky or smelly past the lot line, a residential look, at most four vehicles awaiting repair outside, outdoor storage screened by 2 m of planting or fence; a customer parking lot as a home enterprise unpaved, within 5% of the lot, 3 m from lot lines and 30 m from water and the sea (s. 3.6(c)).

An RV, travel trailer, mobile home, bus or boat lived in long term is a home and counts toward the lot's homes (s. 3.8(2), the definition of dwelling); one only stored isn't (s. 3.8(1)). No accessory building may be used as a home (s. 3.1). Six tent sites count as one home (s. 3.9(4)).

Riparian rule (s. 3.5(2)): on lots the bylaw's Schedule D map marks under the Riparian Areas Regulation, all natural vegetation stays in a 30 m strip along each side of a stream, pond, lake or connected wetland (wider along a ravine), with a qualified environmental professional's report needed to vary it.

Nesting trees (s. 3.5(5)): natural vegetation stays within 30 m of a tree holding an eagle, heron, osprey, vulture, falcon, hawk or owl nest.

Subdivision (s. 3.11): road frontage at least a tenth of the new lot's perimeter and never under 20 m, no lot deeper than five times its width; a lot under 4 ha can't be subdivided to give a relative a home (s. 3.11(3)).

A numbered site-specific zone, LB (1), adds a fibre-optic telecommunication utility on the lands the map marks (s. 4.2(4)).

Site-specific exceptions listed in the bylaw by legal description can add or change uses for one property, and development permit areas, the ALR and building rules apply on top. Confirm with the Islands Trust's office for the island before you buy or build.
